AGREEMENT TO SELL
THIS AGREEMENT
TO SELL is made at Dadu on dated 20-09-2015.
BETWEEN
ABDUL RAHIM S/O. ABDUL KARIM, Muslim, Adult , resident of Nawab Colony Dadu,
hereinafter called as the “VENDOR”
(which expression wherever and whenever the context so permits shall means and
include his heirs, executors, administrators, successors, assignees, legal representatives, attorneys, agents) of
the ONE PART;
AND
GHULAM NABI S/O GHULAM MUSTAFA, Muslim, adult resident of Nawab
Colony dadu hereinafter called the “VENDEE” (which expression wherever and whenever the
context so permits shall means and include his heirs, executors,
administrators, successors, assignees,
legal representatives, attorneys, agents) of the OTHER PART;
WITNESSES
AS UNDER
1.
WHEREAS the Vendor above named is at
the date of these presents seized, possessed and sufficiently is the exclusive
alotee/transferee and owner of immoveable property viz. Plot No. 64, Measuring 2000
feet. Situated at Deh Markhapur Nawab Colony Dadu, hereinafter called the said House.
2.
WHEREAS the Vendor is hereby agree to
sell, convey, assign and transfer and the Vendee is hereby agree to purchase, Plot No. 64, Measuring 2000
feet. Situated at Deh Markhapur Nawab Colony Dadu for lump sum of Rs.20,0000/= (Rupees twenty Lacs aonly)
being full and final settlement toward the sale price of the said Plot No.64, free from all claims, charges,
mortgages, dues, encumbrances or dispute.
3.
WHEREAS the above said Vendor
has received lump sum of Rs 16,00000/= in mode of: House situated at Marvi
Colony = (Rupees Sixteen Lac Only) and remaining amount Rs. 400000/= (Rupees
four Lac Only) Vendee will clear within three Months, viz at the end of 30-12-2015.
4.
WHEREAS the Vendee has hereby paid
the 1600000 lac amount in mode of House situated at marvi Colony dadu to Vendor,
the Vendor
hereby acknowledges. The Possession of both houses will be handed over to Vendee and Vendor also on same footing will be executed in presence of
witnesses.
5.
That in pursuance of this agreement
the Vendor
will deliver the physical vacant possession of the said House to the Vendee
at the time of execution of this agreement.
6.
That all the document, pertaining to
the said Both Houses and entire possession would be handed over by the Vendor to the Vendee.
7.
That the Vendor and his heirs,
executors, administrators, successors, assignees and other legal
representatives will have no right or concern in the said property.
8.
That in future all the demands,
taxes, lease deed, occupancy value etc shall be borne by the Vendee.
9.
That the vendor undertakes to effect
the transfer of the said House/Plot in the name of the Vendee and will do all
acts, things and deeds for the better and more perfectly conveying the said
plot to the Vendee his heirs, executors, administrators, successors, assignees
and other legal representatives otherwise the Vendor will indemnify to
the Vendee.
10. Directions of Plot No. 64 Nawab colony Deh
Markhapur is as under.
East. 20 feet Street
West.
Residential
House.
South. Residential House.
North. Residential
house.
Both
parties are agreed on terms & conditions of the agreement, if both will
violate from the terms, will not be able to challenge the agreement in any
court of law.
IN WITNESSES WHEREOF the aforesaid parties have set their respective hands at
Dadu on the day aforesaid in presence of the following witnesses.
